EB-2 can be employer-sponsored. In eligible cases, a National Interest Waiver may allow the applicant to ask that the usual job-offer and labor-certification requirements be waived. NIW cases depend heavily on the proposed endeavor and supporting evidence.
Who this route suits
Advanced-degree professionals, people of exceptional ability, and eligible NIW candidates.
Employer-sponsored EB-2
Requires an employer to file a petition and, in most cases, complete PERM labor certification. The position must require an advanced degree or the equivalent.
National Interest Waiver
The NIW allows some EB-2 applicants to self-petition by waiving the job offer and labor certification if they can show their work is in the national interest of the United States.
Important to know
Keep employer-sponsored EB-2 and NIW as separate on-page tracks.
